Terms and Conditions

1. Use of the Platform

Somocloud is designed for schools, educational institutions, and their authorized staff to manage student records, finances, NEMIS compliance, CBC tracking, and related operations.

• You must be at least 18 years old or acting as an authorized representative of an institution to use the platform.
• You agree not to use the platform for any unlawful, harmful, or abusive purposes.
• You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.
• You must not attempt to gain unauthorized access to any part of the platform or its related infrastructure.

2. User Content

You retain full ownership of all data and content you upload or generate within Somocloud (e.g., student records, fee schedules, reports). By using the platform, you grant Lano Technologies a limited, non-exclusive license to store, process, and display your content solely to deliver the contracted service. We will never use your institutional data for any other purpose without your explicit written consent.

3. Intellectual Property

All platform content, branding, design, software architecture, and underlying technology are the exclusive intellectual property of Lano Technologies. You may not reproduce, distribute, modify, sublicense, or create derivative works from any part of the platform without prior written permission from Lano Technologies.

4. Prohibited Activities

When using Somocloud, you agree not to:

• Upload or share content that is illegal, defamatory, or infringes on the rights of others.
• Transmit spam, malware, or any other harmful or disruptive code.
• Attempt to reverse-engineer, decompile, or disassemble any part of the platform.
• Use automated bots or scripts to access, scrape, or stress-test the platform.
• Impersonate any person, institution, or entity, or misrepresent your affiliation.
• Resell, sublicense, or otherwise commercialize access to the platform without authorization.

5. Subscriptions and Billing

Access to Somocloud may require a paid subscription. Fees are billed as agreed upon at sign-up. We reserve the right to modify pricing with at least 30 days' notice. Failure to pay may result in suspension of your account. All payments are non-refundable unless otherwise stated in your service agreement.

6. Termination

We reserve the right to suspend or permanently terminate your access to the platform, without prior notice, if you violate these Terms or misuse the platform. You may also terminate your account at any time by contacting us at support@somocloud.org. Upon termination, your right to use the platform ceases immediately and a data export may be requested within 30 days.

7. Modifications to Terms

We may revise these Terms periodically. For material changes, we will provide at least 14 days' notice via email or an in-app notification before the new Terms take effect. Continued use of the platform after that date constitutes acceptance of the revised Terms.

8. Disclaimer of Warranties

Somocloud is provided on an "as is" and "as available" basis, without warranties of any kind — express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from security vulnerabilities. Your use of the platform is at your sole risk.

9. Limitation of Liability

To the fullest extent permitted by law, Lano Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform — including but not limited to data loss, loss of revenue, or service interruption — even if we have been advised of the possibility of such damages.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
